Terms and Conditions

Please, take the time to read this coaching agreement.  It is important that we are on the same page when working together as Coach (me) and Client (you).

 

The following Terms and Conditions are entered by and between you and CYA Enterprises, Inc. (“Company”, “we”, or “us”). Purchasing any Services from us constitutes acceptance of the Terms. The Terms shall not be varied in any way whatsoever unless agreed in advance in writing between the parties.

 

RESPONSIBILITY

By purchasing a coaching session, you warrant that:

  • You are legally capable of entering into binding contracts and You are at least 18 years old.
  • Your Coach will support you in achieving your own results and desired outcomes.
  • You are responsible for the cause of all the changes in your life.
  • Your Coach will work with you to identify solutions and offer suggestions, options and advise based on their own personal experience, training and the information appropriate.
  • You accept full responsibility for all decisions and courses of action.
  • You understand your Coach cannot promise results.
  • You as Client, understand that the coaching services you will be receiving from your Coach are not offered as a substitute for professional mental health care or medical care and are not intended to diagnose, treat or cure any mental health or medical conditions.
  • You as Client, by accepting this Coaching Agreement, agree and acknowledge that the Coach is not a licensed mental health counsellor, medical professional, investment advisor, real estate agent, accountant, and finance, health or legal professional.

 

CONFIDENTIALITY

Your Coach will not divulge that you are in a coaching relationship without your express consent. If you report child, elder abuse or neglect or threaten to harm yourself or someone else, you understand that necessary actions will be taken, and the confidentiality agreement is limited in this capacity. Furthermore, if your Coach is ordered by a court to provide information or to testify, she will do so to the extent the law requires. You, of course, are free to discuss the coaching relationship with anyone at any time.

 

SCHEDULING

All coaching sessions are scheduled in advance by direct agreement between you and your Coach. If for any reason you cannot attend a scheduled coaching session you are fully responsible for informing your Coach and rearranging an appointment at least 48 hours in advance, otherwise the session will be deemed forfeit. You are responsible for rescheduling via email info@cyaenterprises.com,

 

CANCELLATION POLICY

We request that you cancel at least 48 hours before a scheduled coaching session. You may cancel by phone or email. If you have to cancel your coaching session before the 48 hours, we will offer you a credit, to your account; but do not offer refunds. You may use this credit towards a future coaching session. However, if you do not cancel prior to the 48 hours, you will lose the payment for the session. The owner has the only right to be flexible here.

 

CYA Enterprises, Inc. reserves the right to reschedule or cancel any scheduled sessions or to replace personnel due to circumstances beyond our control. If a session is rescheduled or cancelled, participants will be given notice by CYA Enterprises at least two business days before the start of the coaching session. You may then enroll in the next available offering of the program. Should this occur, if desired by the client, all fees collected to date will be refunded.

 

LATENESS DURING COACHING SESSION

We understand that circumstances can lead to delays. Unfortunately, to keep other appointments on time, it is extremely unlikely we will be able to extend the session and it will still have to finish at its scheduled time and you will be charged in full for the complete session. Once your scheduled session begins, if there is a “no show” after 30 minutes into the scheduled session, the remainder of the session will be cancelled and with no refund. Therefore, please plan in advance to be on time.

 

FORMAT OF SESSIONS

Coaching sessions will be conducted as individual one-to-one sessions via phone or video conferencing. Coach will provide client with contact information for scheduled conference. Client is responsible for being available and on conference call at the agreed time.

 

LIMITATION OF LIABILITY

·We shall not be liable to you for any loss or damage (including without limitation, any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, and whether in tort (including without limitation negligence, contract or otherwise) that may result in connection with the Services.

·Our liability to you shall at all times be limited to the amount paid, if any, by you for the Services.

·You hereby release, waive, acquit and forever discharge CYA Enterprises, Inc, your Coach, any agents, successors, assigns, personal representatives, executors, heirs and employees from every claim, suit action, demand or right to compensation for damages you may claim to have or may have arising out of acts or omissions by yourself or Coach as a result of the advice given by your Coach or otherwise resulting from the coaching relationship contemplated by this agreement.

 

ENTIRE AGREEMENT

These terms together with our booking confirmation constitute the entire agreement between the parties and shall exclude any other agreement, or understanding of any kind, whether oral or written, relating to the Services.

 

 

The scheduling of your Brainstorm Coaching session confirms your agreement of our Terms & Conditions.
